Car Incident Advice Anyone?

Hey everyone, don't post much here but I've read posts like this and some good advice comes out so im going to give it a try.

I quit my job last week based on the boss screwing me with money and other reasons, was there for a month. In that time, using the companies f450 cube van, scratched another employee's car in the parking lot. The boss doesn't want no part of it, i.e does not want to go through the business' insurance company. I'm willing to pay to fix the damage but becuase I was using the company's truck, the company is liable not me personally, right?

If the company is liable, and I have to company's insurance info, can this be fixed without asking the boss' permission to go through insurance? I've never filed a claim before or did any of this. I feel bad/stupid for hitting the guy's car and I will pay to have it fixed out of my own pocket but I don't have the money right now, and if I'm not liable I don't plan to pay. Does anyone understand my jiberish, how would I go about this situation? Any advice would be really cool.

Just tell the employee's car that you hit his car with the company vehicle and to pursue it through management.

um.
If its with another car, im fairly sure it goes on YOUR personal insurance. this is just what i was told when i was learning to drive with our landscaping trailer. they said if there was a problem, to risk damage to the trailer, because that is covered by the COMPANY insurance. rather than swerving for example, and hitting another car... because that would be MY insurance.

Probably depends on state and insurance type.

I would say that if you got in a wreck in a company vehicle on company time being an employee of said company damages would go back to the company's insurance.

Points and tickets may go on yours.

Thanks for everyone's input and advice, much appreciated. Just some more info, to get my pay from this company, they wanted to me to open a business and subcontract to me. They treat us like employees, just they pay us as a different company. I left this job becuase they wanted me to do res. heating and a/c jobs that I am not licensed for, therefore left becuase I didn't want to run into trouble considering I opened a business under my own name. This guy has pretty much every angle covered sub contracting to me.

I talked to the boss today and he wants no part of fixing the guys car. So I'm think I'm going to offer to pay for half the damages becuase I feel it would be wrong to just leave this guy stranded. So thats what I'm thinking right now

i used to sub contract for a company and drove their vehicles. i had a accident while i worked there and they paid for it. although i wasnt at fault

It just sucks dealing with bullsh*t like this. Just want this situation fixed and done with. I'm going to get an estimate tomarrow on his car if he is available and then think of what to do.

I have dealt with a situation of sub contracting when i should be considered an employee.

the irs has a set of protocols that they use to determine if someone is an employee or a sub contractor and some people (companies)try to skirt these to make crap cheaper.

94 firechicken, thanks for the link. Im canadian, but same should apply. I'm pretty much yes to almost all of those situations, im definitely an employee for the company. Im about 99 percent certain that the company should be paying for this damage. But becuase I hit the guy, may sound stupid, to make this situation sit right with me, I'm going to offer to pay for half of the damage. If he doesn't accept, them I'm not paying for anything. I appreciate everyone's input and telling me who is in the wrong here.

I am about to report a previous employer to the irs for doing to me what yours was doing to you. and from what i have read he will be out of buisness....its tax evasion and fraud.
