What would you do?

Ok, so I sold a guy on tech my old rims for $425 shipped with new tires. I told the guy about the chrome bubbling and cracking inside the rims, and were one rim and a small area of curb rash. the rims are 11 years old. He now says I lied to him and never said the chrome was cracking, yet he didnt request pics of the inside of the rims.

It took this guy a week and a half to finally pay for the rims, and he complained everyday that the shipping was taking to long. He's threatened to file a dispute everyday for the last 3 days.

heres his last 2 emails...

You just sold me rims that are pitting severely and purposefully left out this detail when asked about the condition of the wheels. You can either step up and do the right thing or we can do this the hard way. If I don't hear from you soon I'm going to file a dispute through squaretrade.com. It's your choice.

my responce: Rims were sold as is and not in new condition. I warned you of the cracking prior to your purchase. You agreed to buy them. Check your PM's. You WERE notified that the factory chrome had bubbles and was chipping. Sorry its not to your satisfaction. But you made the purchase with prior knowledge of the rim conditions.

his latest email: You certainly did not. You said that the only thing wrong with them was one rim had very minor curb rash. I asked you to send me pictures of that and told you I would purchase the rims if you could assure me that that was the only thing that was wrong with them and asked you at that time to please tell me if the rims were only in good to fair condition. You said you had already sent me those pictures and mislead me by not telling me about the true condition of the rims in your response to that request. Your ad didn't say anywhere "sold as is" and it did not mention bubbling of the chrome whatsoever. Pitting and bubbling on all the rims is not the same thing as minor curb rash. I don't want to call you a liar but you're just not telling the truth. And if you refuse to acknowledge that I'm going to have to resort to filing a dispute.

Anyways he has the pics that he requested, and now wants to take action cause the rims he bought are not to his satisfaction.

What would be the best route to go about getting this guy happy?

You wont get him happy. He wants the rims and part of his money back and if he thinks he can pressure you into giving him what he wants he will keep trying. Make sure you have records of all correspondence between you two and tell him that he either needs to stop harassing you and accept the rims or he needs to file a complaint and show proof that you lied to him. Be nice about it, but don't let him pressure you into giving him any of his money back, as long as you were upfront with him to begin with you have nothing to worry about.

If you have the PM's to back up your story that you did in fact tell him about the pitting and condition of the rims, let him file his dispute... If you can show that you were honest about the condition of the rims and he willingly agreed to the purchase, then he has no argument and you will will the dispute...

If you don't have the PM's anymore, or you didn't actually tell him about the condition of the rims, the dispute will go in his favor most likely...

The guy emailed me back wanting money but not for me to buy the rims back. I let him know that I would not freely give money back, but would only buy them back at his disgresion.

heres the latest emails:

me: only tires were advertised as new. Rims are 11 years old, and reflect the normal wear and tear for the age. Whats gonna make you happy?

him: If I had known the condition the rims were actually in, I wouldn't have bought them. Even though I think I was mislead I want to try to be reasonable. Returning the rims completely just isn't worth it because of the shipping costs that both parties would have to absorb and then we'd both be out money. But, the corrosion is something that has to be addressed immediately so the condition of the wheels doesn't worsen. That means I'm gonna have to get them redipped or stripped and painted on the inside, which is money I have to spend on top of the purchase price so I end up paying more than I intended for a set of wheels that are actually in worse condition than I thought. I think I deserve some money back for that.

me: I will not freely give out money cause your unhappy with a used item in a used condition. You want a free ride? Use the wellfare system. The only reason I will give you money is to purchase the wheels back which you say your not interested in doing.

him: Oh, so your willing to refund my money and pay for the cost of shipping them back to you, right?

me: You have made the transaction difficult from the start by lowballing the price, delaying payment, and now expecting money for free. I will buy my rims back for the $437.50 shipped. You've made it blatenly obvious you will not be happy until I up and give you money. I will gladly take my business elsewhere. Good day sir.

him: Yeah, why should I have to put up money to send back a product that wasn't what I paid for? Doesn't make any sense does it. It's not free money for me. It's the cost of you doing shady business. Your original ad said nothing about chrome peeling on every rim. When I asked you straight up what the condition of the rims were you still didn't say anything. That's called being a scammer. I guess I'll be keeping the rims then and warning other people about your bs. Thanks for wasting my time and money.

me: My offer was to refund the exact amount you paid to have the wheels shipped to avoid any further business with you as a customer. Its your choice to refuse it. Good day sir

If he was really pissed about the condition of them, he'd gladly take the exact same amount of money and ship the wheels back to you.

He's being a jerkoff, ignore him. If he tries to slander you, just post that exact same thing, bolding the part about him not wanting to return them for the same amount he paid.

I offered to buy them back twice but he keeps wanting money. I dont feel obligated to kiss his ass and give him the $250 that he wants. I may get a bad seller feedback,, but I'm not gonna let one guy spoil my mood. I bought and sold hundreds of parts from many boards with no problems til now.

Since you are posting everything else post sale, why not post up the original add and/or pm's which show you conveyed the correct condition of the rims to him...

Is he from Colorado?

Me and my grandpa had almost the EXACT same thing happen when we sold his 68-69(i forget) AMX.

He complained right away that it wasn't as described and wanted $2,500 back, then wanted the whole car shipped back and his money back if we paid the shipping. Yadda yadda...he filed through squaretrade, we told them the story that he was full of shit and that the car was sold as is and was in AS DESCRIBED condition (which was damn near perfect). I told them to close the dispute. He tried EVERYTHING he could but he had BOUGHT something off of the internet AS IS.

He lost, and we haven't heard from him since.

Just tell him to shutup or threaten harrassment charges.

I'm with "Red Hot Z28".......why not post all the details? ( If you are under protection from an agent, then I understand not posting details as of yet. ) If this dispute is not under agent, then I would post as much as possible to show my good nature and intentions in the deal. Being sketchy and indifferent creates curiosity on these forums....wich could create sketchy responses here.

Fuck him. Those wheels and tires were worth more than what he paid for them in the condition they were.

You could barely tell they were screwed up when they were on the car, I never even noticed anything wrong with them when you had it at my house.
