Florida Subpeonas served to Maryland Resident

Posted By: blackcamaro On: 11-03-2009 @ 09:30:13         Reply | Edit
My question involves criminal law for the state of: Florida

Hello,
I am in Maryland and was served a subpoena from the state of Florida. I witnessed a murder, but I believe they will not need me. I do not want to go to Florida as I will probably be laid off from work. There is a possibility they will hire me back on, but I have to attend THREE different cases in a month.

Will the state fly me to Florida to testify?
I was told that Monday they would know for sure if they need me, can I claim hardship so I would not have to attend this trail?

As I understand it laws regarding subpoenas recently changed for an out of state issuance.

I would like to know my options when dealing with this situation.

It is a Murder case.

...you really need to re-evaluate your anecdotal skills.

is that you?

is that off of some site?

want to give some background?

are you trying to solicit opinions?

are you trying to solicit an answer?

Sarav, how hard is it to follow Nietzsche? I read Machiavelli's The Prince earlier this year, and the only thing that was clear was to not trust mercenary infantry while fighting on the peninsula.

Failing to follow a subpoena will result in a contempt of court charge and a bench warrant.

Was it a subpoena by the prosecution or the defense?

Call the DA, explain the hardship, & ask them who is paying for this. Tell them you do not have the means (finances) to make the trip and it is going to cause you to lose your job.

Don't take this as actual fact but I was fairly sure a job is required to return your old job after you are done as a result of a subpoena...

I'm also 99% sure they will reimburse you for travel and housing but that is pretty much it.

One CAN petition as hardship.

This really sounds like a question better suited for a lawyer, not fbody guys, or me for that matter.
